The regulation of e-bikes and motorized scooters in Key Biscayne, Florida has encountered obstacles, causing potential delays in reaching a binding agreement. It is now expected that a consensus will be reached by September.

The Florida Senate has remained undecided on House Bill 7049, which aimed to grant municipalities like Key Biscayne the authority to regulate these micro-mobility devices. As a result, further options are being explored, and it is likely that the current 60-day ban in the Village will be extended.

One proposed solution is an ordinance put forth by County Commissioner Raquel Regalado. The first reading of this ordinance, which will allow Key Biscayne to regulate micro-mobility devices on County-owned Crandon Boulevard, is scheduled for March 19. If the Board of County Commissioners approves it in May, an inter-local agreement will be necessary before the Village can establish its permanent ordinance in July.

However, changing laws is a slow process, especially when the involvement of the County and State Department of Transportation is required. Despite the frustrations associated with this, the ultimate goal is to ensure public safety and address the concerns of various stakeholders.

Key Biscayne’s Village Attorney, Chad Friedman, has acknowledged the inadequacy of the existing law regarding micro-mobility devices and the need for amendments. He emphasized the Village’s authority to control traffic movement and parking, as well as to impose longer bans if deemed necessary. Education and enforcement will play crucial roles in any new regulations that are implemented.

Throughout the ongoing discussions, Council members have expressed differing opinions on specific aspects of micro-mobility regulation. Some propose banning higher-speed bicycles, while others believe that clear distinctions between different types of bikes would aid enforcement efforts.

In the meantime, Key Biscayne will continue to enforce the current ban on micro-mobility devices unless significant progress is made. It is important to find a consensus that prioritizes public safety and addresses the concerns of all parties involved.
